Varnish Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to your access to and use of any Varnish products and services (collectively, the “Services/Offering”). Capitalised terms not defined in this AUP have the meanings given in the main agreement between you and Varnish.

1. General Requirement

You must not use, or allow any third party to use, the Services/Offering in any manner that violates applicable law, infringes third-party rights, harms Varnish, the Services/Offering, other customers, end users, or the public, or interferes with the integrity, security, availability, or performance of the Services/Offering.

2. Prohibited Content and Activity

You must not use the Services/Offering for any content or activity that:

  1. is unlawful, harmful, fraudulent, deceptive, defamatory, obscene, or otherwise objectionable;

  2. infringes, misappropriates, or otherwise violates any intellectual property, privacy, publicity, confidentiality, or other rights of any person;

  3. promotes, facilitates, or enables phishing, spoofing, impersonation, scams, or other abusive or deceptive practices;

  4. contains or distributes viruses, worms, Trojan horses, ransomware, malware, botnets, or other harmful code or tools;

  5. compromises, disrupts, disables, overburdens, or impairs any system, network, website, application, service, or underlying technology;

  6. involves unauthorised scanning, probing, penetration testing, scraping, crawling, data mining, or attempts to gain unauthorised access to systems, accounts, data, or networks;

  7. promotes, facilitates, or depicts child sexual exploitation or abuse, human trafficking, terrorism, or other serious criminal activity;

  8. incites, threatens, or promotes violence, physical harm, or unlawful discrimination against any person or group; or

  9. otherwise exposes Varnish, its customers, users, partners, or service providers to legal, security, operational, or reputational risk.

3. Abuse of the Services/Offering and Reporting

You must not use the Services/Offering to:

  1. send unsolicited communications or facilitate spam;

  2. generate abusive, excessive, or artificial automated usage or system load;

  3. evade usage limits, quotas, billing mechanisms, security controls, or technical restrictions;

  4. interfere with Varnish’s monitoring, logging, security, or abuse-prevention mechanisms; or

  5. mask origin, destination, or operational data for unlawful, abusive, or deceptive purposes.

Please direct any abuse reports or complaints to compliance@varnish-software.com. You agree to cooperate in resolving complaints and take prompt remedial action. Varnish may share your technical contact details with complainants or authorities when legally or operationally required.

4. Security Responsibilities

You are responsible for properly configuring your use of the Services/Offering, securing your infrastructure and systems, maintaining the confidentiality and security of all credentials (such as usernames, passwords, tokens, and license keys) associated with your account, and promptly addressing vulnerabilities or abuse reports. You remain responsible for all activities conducted under your credentials. You must promptly notify Varnish of any actual or suspected unauthorised access or security incidents. Varnish may suspend or revoke credentials that it reasonably believes have been compromised and will notify you accordingly.

5. Enforcement

If Varnish reasonably determines that you have violated this AUP, Varnish may take action, including:

  1. notifying you and requesting remedial action;

  2. limiting, filtering, blocking, or removing access to offending data, systems, or functionality;

  3. suspending or restricting access to the Services/Offering in accordance with the main agreement between you and Varnish; and/or

  4. reporting unlawful or harmful activity to law enforcement or relevant authorities.

We will provide notice before enforcement where practicable, but reserve the right to act immediately to protect the Services/Offering, other customers, or comply with applicable law.

6. Updates

Varnish may update this AUP from time to time to reflect changes in applicable law (including data protection law), industry standards, or updates to the Offering. Non-material changes will take effect upon publication. For material changes, Varnish will use reasonable efforts to provide you with at least 30 days' prior notice. What constitutes a material change will be determined at Varnish's reasonable discretion.
